Terms of Service — ZdamyTeorie.pl
This is an English-language translation provided for convenience. The Polish-language version is the legally binding version and prevails in case of any discrepancy.
1. General provisions
These Terms of Service define the rules for using the ZdamyTeorie.pl website, available at ZdamyTeorie.pl, including the rules for the electronic provision of services, the rights and obligations of Users, and the rights and obligations of the Service Provider.
The owner and administrator of the website is Radosław Klesyk, operating a sole proprietorship under the business name OSK Patrol Radosław Klesyk, with a correspondence address of: Bratkowice 824, 36-055 Bratkowice, Poland, NIP (tax ID): 5130435188, email: kontakt@zdamyteorie.pl, hereinafter referred to as the "Service Provider".
The Terms of Service are made available free of charge on the Website in a manner that allows them to be obtained, reproduced and saved.
Using the Website means that the User has read the Terms of Service and accepts them to the extent necessary for using services provided electronically.
2. Definitions
Website – the ZdamyTeorie.pl website together with its functionalities, subpages, resources and materials made available electronically.
User – a natural person using the Website.
Service – any functionality provided electronically by the Service Provider within the Website, in particular making tests, questions, educational materials, progress statistics, preference-saving functions or other learning tools available.
Materials – content available on the Website, including questions, answers, descriptions, explanations, graphics, multimedia, interface layout, text elements, compilations, summaries and other content presented to the User.
Device – the end device from which the User accesses the Website, in particular a computer, tablet or phone.
3. Nature of the Website
ZdamyTeorie.pl is a private educational website supporting study for the driving theory exam.
The Website is not a public administration body, is not a driving test centre (WORD), is not an examination body and does not act on behalf of or on the instructions of the Ministry of Infrastructure, provincial road traffic centres or other public entities, unless expressly stated otherwise.
The purpose of the Website is to facilitate learning and preparation for the theory exam. Use of the Website is supplementary and educational in nature.
The Service Provider makes every effort to ensure that the Materials are current, complete and useful; however, it does not guarantee that using the Website alone will ensure passing the state exam.
4. Scope of electronically provided services
The Service Provider provides in particular the following services electronically through the Website: making tests and question sets available, making educational materials related to theory study available, presenting results, progress, session history or statistics, saving selected settings, preferences or the User's progress on the Device, and making a contact form and other contact tools available, if available.
As of the date of publication of this version of the Terms of Service, the use of the basic functionalities of the Website is free of charge, unless expressly stated otherwise for a specific service or functionality.
The Service Provider may in the future introduce additional functionalities, including paid, premium or registration-required functionalities, on terms described separately or in an updated Terms of Service.
5. Technical requirements for using the Website
To use the Website, a device with internet access, an up-to-date web browser supporting modern web standards, enabled JavaScript support and the ability to save cookies or similar technologies are required, if they are required for the correct operation of selected functions of the Website.
Some Website functionalities may not work correctly if an outdated browser is used, scripts, cookies, localStorage or other mechanisms required for the Website to operate are blocked, or software that interferes with the Website's operation is used.
The Service Provider reserves the right to temporary technical interruptions, updates, maintenance work or restrictions on Website availability.
6. Rules for using the Website
The User is obliged to use the Website in accordance with the law, the Terms of Service, good customs and in a manner that does not infringe the rights of the Service Provider or third parties.
The User may use the Website exclusively for their own educational purposes, unless the Service Provider expressly permits a different scope of use.
In particular, the following are prohibited: providing unlawful content, taking actions that may disrupt the operation of the Website, circumventing technical security measures, limits, blocks or protective mechanisms, using bots, scripts, crawlers, scrapers or other automation tools to download data, index resources, copy materials or simulate user traffic without the prior written consent of the Service Provider, mass downloading, copying, recording, exporting, archiving or secondary distribution of Materials or substantial parts of Materials, attempting to gain unauthorised access to resources, code, databases, logs, accounts, administrative mechanisms or Website infrastructure, and exploiting errors, gaps or unintended functionalities of the Website in a manner contrary to its purpose.
The User acknowledges that the Service Provider may use organisational and technical measures to detect abuse, automated traffic, attempts to circumvent security measures, excessive overloading of the Website and other actions contrary to the Terms of Service.
7. Copyright and rules for using Materials
Unless mandatory provisions of law provide otherwise, all rights to the Website and its elements, in particular to the layout, compilations, descriptions, texts, summaries, interface, designations, graphics, functionalities, code, composition of materials and other protected works or elements, belong to the Service Provider or entities cooperating with the Service Provider.
Using the Materials made available on the Website does not mean that the User acquires any rights to those Materials beyond the right to use them in accordance with the Terms of Service and legal provisions.
Without the prior consent of the Service Provider, the following are prohibited in particular: copying Materials in whole or in substantial part, making them publicly available, further distributing, publishing, selling or licensing them, creating competitive databases, compilations, applications, platforms or services based on them, and downloading Materials in an automated or systematic manner.
8. Progress-saving, settings and statistics functions
In order to improve the operation of the Website and the convenience of its use, the Service Provider may use mechanisms for saving the User's settings, progress, session history, statistics or preferences on a given Device.
These mechanisms may affect the way content is presented, the order in which questions are displayed, and the saving of results, progress or interface settings.
Deleting browser data, cookies, localStorage or using a different Device or browser may result in the loss of saved settings, history or statistics.

9. User account
As of the date of entry into force of these Terms of Service, the Website does not provide registration, login or User Account functionality.
If account functionality is made available on the Website in the future, the terms and conditions for creating and using it will be specified in an update to the Terms of Service or in a separate part of the Website.
10. Liability
The Service Provider exercises due diligence to ensure that the Website operates correctly, stably and securely.
The Service Provider is not liable for: interruptions in Website operation caused by force majeure, network failures, failures of external service providers, technical work or causes beyond the Service Provider's control; incorrect operation of the Website resulting from the User's failure to meet technical requirements; consequences of using the Website contrary to the Terms of Service; decisions made by the User on the basis of content available on the Website; or failure to pass the state exam, despite using the Website.
No provision of the Terms of Service excludes or limits the rights of a User who is a consumer, if such a limitation would be prohibited by mandatory provisions of law.
11. Access blocking and anti-abuse measures
In the event of a confirmed or reasonably suspected breach of the Terms of Service, legal provisions, the security of the Website or the rights of the Service Provider or third parties, the Service Provider may take measures adequate to the scale of the breach.
These measures may include in particular: temporarily limiting selected functions, blocking access to the Website or parts thereof, limiting traffic from specific sources, addresses or sessions, rejecting automatic or excessive requests, and deleting or blocking an account, if account functionality exists.
The Service Provider may also take the measures described above in order to protect the integrity of the Website, continuity of operation, quality of services and protection of correct access for other users.
12. Complaints and contact
The User may submit complaints, comments, errors or problems regarding the operation of the Website electronically to the address: kontakt@zdamyteorie.pl or via the contact form available on the Website.
A complaint should, where possible, contain contact details for a response, a description of the problem, the date on which the problem occurred, and information enabling the circumstances of the error to be identified, if known.
Complaints will be handled within a reasonable time, no longer than 14 days from the date of receipt, unless the nature of the matter justifies a longer processing time, about which the User will be informed.
13. Personal data and privacy
The rules for processing personal data, the use of cookies and similar technologies are set out in the Privacy Policy available on the Website.
The Terms of Service and the Privacy Policy are separate documents that should be interpreted together to the extent that they concern the use of the Website.
14. Changes to the Terms of Service
The Service Provider may amend the Terms of Service in the event of a change in legal provisions, development or change of Website functionalities, a change in the service delivery model, the need to clarify provisions of the Terms of Service, and the need to improve security or counteract abuse.
The amended Terms of Service will be published on the Website together with information about the date of entry into force.
Changes to the Terms of Service will not affect acquired rights of Users, if such rights arose before the changes came into force.
15. Final provisions
In matters not regulated by the Terms of Service, the relevant provisions of Polish law shall apply.
The Terms of Service have been drawn up in Polish. In the event of foreign-language versions being made available, the Polish-language version is binding, unless mandatory provisions of law provide otherwise.
If any provision of the Terms of Service proves to be invalid or ineffective, the remaining provisions remain in force.
